1) The owner/consignor (owner) and the Heisey Collectors of America, Inc. (HCA) shall enter into an agreement for glassware items listed and selected by HCA or donated for sale by HCA for the benefit of the National Heisey Museum.
2) All items consigned or donated for sale are to be made by A. H. Heisey and Company. No reproductions by any other glass company will be accepted. HCA can select any/all items it chooses to place for sale at the auction.
3) The HCA Board of Directors Executive Committee (committee) will set the final date by which a list of glass from the owner must be received by HCA, will set a date by which it will notify the owner of its decisions on glass selected, set a final date for glass from the owner to be received by HCA at the museum, and set the date of the select auction. The committee may also solicit glass at the convention but before the deadline if necessary to have an acceptable quantity and quality of glass for auction.
4) Each HCA member is considered an owner and can donate an unlimited number of items to be sold at the auction by HCA. HCA, at its discretion, has the right to add any donated item it chooses to its glass collection or sell in the museum shop.
5) Each owner may send a list of glass of no more than forty (40) lots for sale at the select auction. There is no limit of the number of items in each lot. The committee retains the right to increase/decrease the size/makeup of any lot. The committee will not combine lots from different owners. The committee, at its option, may select or not select lots from a list submitted by any owner. The committee will not knowingly select damaged glass.
6) Glassware for the select auction will be accepted by HCA only after the owner is informed of the lots selected by the committee. The committee will not accept damaged glass. The committee will inform the owner of the final date glass will be accepted (see 3 above). Glass not submitted by the final date, at the option of the committee, may not be accepted.
7) Owners of glassware for sale in the select auction will be charged 20% commission per each lot consigned. The minimum commission will be $5.00 for 2010.
8) The owner agrees to accept all responsibility to provide merchantable title for all glass sold.
9) HCA agrees to provide settlement in full for glass sold not later than fifteen (15) days after the completed auction.
All monies received from the sale will be held in and expenditures paid from the HCA Trust Account. The owner is responsible for delivery of the glass to the National Heisey Museum. HCA accepts responsibility for the glass when received at the museum, except any glass damaged in shipment will be referred back to the shipper and owner.

11) Glass damaged or lost while in the possession of HCA prior to the sale will be valued by a qualified appraiser or appraiser selected by HCA and the owner will be paid on this basis, less commission.
12) In the event no bid is received on a lot, that lot becomes a donation to HCA. The minimum mail bid and the minimum opening bid on any lot will be $15.00. The minimum incremental bid increase will be $2.50.
13) The committee is authorized to reject any glass not deemed acceptable for sale in accordance with HCA standards, plus any glass, as determined by the committee, not made by A. H. Heisey and Company. Damaged glass will not be accepted. These rejected and non-Heisey glass items will be returned to the owner if they desire, at their expense. If the owner does not want the item(s) returned or refuses to pay for shipping, the item(s) become the property of HCA.
14) The maximum number of lots to be sold at the select auction will be as determined by the committee.
15) The committee will catalog glassware for the select auction and place it for auction in an order it deems in the best interest of HCA.
